Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChatterMock (the "Service"), operated by Noel Periarce ("ChatterMock", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use ChatterMock
You must be at least 18 years old and able to form a binding contract. The Service is a business tool for hiring and evaluating chat operators for adult-content management agencies. You are responsible for ensuring your use complies with all laws that apply to you and to the people you assess.
2. Accounts
You are responsible for your account credentials and for all activity under your account, including that of any team members you invite. Tell us promptly if you suspect unauthorized use. You are responsible for the accuracy of the information you provide.
3. Your content and applicant data
You may configure grading criteria, model personas, AI "fan" personas, and content vaults, and you may invite applicants to complete assessments ("Your Content"). You retain ownership of Your Content. You grant us a limited licence to host and process it solely to operate the Service for you.
You represent that you have the right to submit Your Content and to collect and process the information applicants provide (such as names, email addresses, uploaded files, and chat responses). You are the controller of applicant data; you are responsible for having a lawful basis to collect it and for informing applicants how it is used. See our Privacy Policy.
4. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to assess or depict minors or non-consenting persons;
- upload malware, or attempt to breach, overload, or probe the Service or its rate limits;
- reverse engineer, resell, or provide the Service to third parties except as expressly permitted;
- misuse invite links or attempt to access data belonging to other agencies or applicants.
The Service uses third-party AI models to role-play fans and to grade transcripts. AI output can be inaccurate. Grading is a decision-support aid, not a guarantee — hiring decisions remain yours.
5. Plans, billing, and credits
Paid plans are billed in advance on a recurring monthly basis through our payment processor. Plans include a monthly allowance of assessments; the free trial includes a one-time allowance. Prices and allowances are shown on our pricing page and may change on renewal with notice. Failure of a renewal payment may result in downgrade to the free tier. Refunds are governed by our Refund Policy.
6. Cancellation
You may cancel auto-renewal at any time from your billing settings. Access continues through the end of the period you have already paid for, after which the account reverts to the free tier. We may suspend or terminate accounts that violate these Terms.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI grading will meet any particular standard.
8. Limitation of liability
To the fullest extent permitted by law, ChatterMock will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, notified to you. Continued use after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of The Republic of the Philippines, without regard to conflict-of-laws rules. Disputes will be subject to the courts of that jurisdiction.
